Report Card

The new Supreme Court nominee has not done well when the Supreme Court has reviewed her rulings. They have overturned 5 of her decisions out of 6. That's not a good grade.

Secondly, she's not a Second Amendment upholder. In her ruling to allow government to ban privately owned weapons belonging to New York citizens, Sotomayor wrote: "The Second Amendment applies only to limitations the federal government seeks to impose on this right . . . not upon that of the state." Since her reading of the 2nd Amendment only forbids Congress from seizing your guns, the New York State Assembly was fully authorized to ban and seize ANY AND ALL of your weapons, according to Sotomayor's anti-liberty reasoning.

Maybe she doesn't really hate white men. Maybe she's not color sighted. But what about her track record? Shouldn't the highest court in the land consist of our brightest, best, and blindest?

Jury Instructions

"In deciding the facts of this case you must not be swayed by bias or prejudice or favor as to any party. Our system of law does not permit jurors to be governed by prejudice or sympathy or
public opinion. Both the parties and the public expect that you will carefully and impartially consider all of the evidence in the case..."

I found these instructions from a civil case heard in Chicago. Most all jurors have heard similar words. They are not permitted sympathy. The law is blind to wealth, race, political status, family situations, etc.

However, empathy (similar to sympathy) was the number one criteria for our new Supreme Court Judge. Give us a break. Most of us took a basic civics class in high school and many have served on a jury. The law is blind. Most statues depicting her has her holding a scale with her eyes covered.

Now this new judge will judge from empathy. The law will have feelings. The law will bend for individuals. The law will understand feelings and, thereby, discriminate against race, status, wealth, etc.

God help us.

Ethnic Based?

Obama's new judge is Latino. She's empathetic. Those are the two selling points. Dare the Republicans find a voice against her nomination it will because she was a Latino and empathetic. Suicide for the party.

How come it doesn't work that way for the Dems?

George W. Bush nominated Estrado to the appellate court and he was denied. Samuel Alito was denied consideration to the Supreme Court. His father's choice of Clarence Thomas was raked over the coals in 1991.

Latinos and African-Americans to the court. The Dems can reject these people for little more than their skin color and yet it does no damage to their popularity with minorities.

The GOP fears the loss (they don't carry them ever) minorities and unlikely will voice any opposition at the hearings ahead.

Dr. King wanted his little children judged by the content of their character and not the color of their skin. Will/can we ever get past race?

Sonia Sotomayor thinks it OK to discriminate against white and Hispanic firemen in Connecticut. She judged against their character and judged them the wrong color. No African-Americans passed the tests.

All we hear is the first Latino on the highest court. Not because the GOP didn't try. It should lie at the feet of Dems that they denied the first Latino nominated.

Local Taxes

Many states divide real estate taxes into two or three installments. Indiana's payments are due May 15 and November 15. Illinois' payments are due June 1 and September 1.

I've always found Illinois a challenge as we usually have vacations during the summer and need to plan for those costs plus making our real estate tax payments timely.

As I am thinking of this, just a reminder that if you make estimates to the Federal government toward your year's income tax liability, another 1/4 of that amount is due June 15.

Federal estimates are due on or before April 15, June 15, September 15, and January 15. The only variance is if the due date falls on a weekend. Then Uncle Sam gives us until that Monday. The payment does not have to be received by those dates but must be postmarked on or before those dates.

Taxes - never forget to budget for them.

1934, Carey Orr


Check this out. This cartoon appeared in the Chicago Tribune in 1934.
Unlike today, newspapers and commentaries in major venues expressed their concerns of the administration.
I remember my grandfather telling me about his worries during the Great One. He worked at all types of jobs but refused to take a handout from the government. He could have gotten one of those "make work" jobs building roads, etc. to support his young family, but he had his convictions.
Grandpa worked for an automaker, a small one in Indiana, off and on. He refused to join or even consider voting for a union. The company did not survive the Depression and he eventually found work in a factory near home. His convictions kept him from a union shop and bigger compensations. He was free and lived his life happily.
His voice is the strong anti-FDR I recall growing up. My father-in-law, right out of high school, worked some in the Tennessee Valley projects and in some CCC camps.
Like the Depression, my husband's dad got regular work as the United States entered World War II. That's what got us out of the depression. Will it take another world war or will we crumble under the weight of spending and borrowing?

Memory

I am old enough to remember interest rates of the late 1970s and early 1980s. We were transferred to Illinois in 1985. Because we were able to sell our Indiana house quickly and the company was offering buy outs for the dozens of families facing the same move, we were granted extra $ to buy down our rate.

We applied for and were approved for a 12.75% mortgage which was due to our excellent credit rating. We used the company $ and paid several thousands up front and bought down our mortgage to 9.75%. We were going to make it. We could, with extreme budgeting, make that $1,100 monthly payment.

Back in 1980, we were contacted by our credit union. They were offering a special savings account and with our saved amount, we qualified. We moved over $20,000 to this new account which paid zero interest on the first $1,000 and 13.25% on the remaining balance.

I heard a prediction this week. This talking head sees us revisiting the days of Carter. This is just a reflection triggered by one economist's prediction.

Hoosiers Screwed

On May 6 I wrote about the debtors holding note against Chrysler being robbed: "He has willed controlling ownership to the UAW. A nice bequeath. Not overly valuable since there are all those debts attached. To name a few I would include a couple billion due We The People, a large hunk due those lenders that Obama does not stand with, the pensions and very generous benefits due Chrysler retirees, and an unknown amount due parts makers, utilities, and taxes."

The State Treasurer put numbers to my claim. Richard Mourdock said that the changes made by Obama to investment rules in bankruptcy have cost many Hoosiers. He listed losses including $4.6 million in The Indiana Teachers' Retirement Fund (they hold $6.9 million holdings).

Mr. Mourdock said the losses should not have happened. Obama placed the financial interest of others above secured lenders. "It's just flat-out wrong. It's not right that state policemen and teachers suffer this loss."

The current administration's answer to this claim: "Indiana workers and their families know that saving American jobs must be a top priority during these difficult economic times, and that's what the administration has done."

For the better good. Not for what is right. Not what is the law but what is best for the common good. Common good. Communistic?

Richard Mourdock is revamping his office's policies to specify that investment managers should not buy more secured debt from companies receiving federal bailout $. He urges other managers of Indiana retirement funds to do the same, like the universities.

Take federal $, be considered poison to investors and Hoosier retirement funds.

Meanwhile the dictator gets away with breaking the law and stealing from over 41,000 retired teachers in Indiana -- for the common good.

Dick Cheney

Dick Cheney is a voice without hidden agenda. He does not want to win votes for himself or any other person. He is a voice with principles. He has something to say with or without an audience. Many are shocked that he did not retreat to his ranch, write a book, and die without a peep.

The GOP needs to get back to substance and away from personality. The country fell in love with a personality with no revealed agenda. Obama was not without an agenda but one that would not have been endorsed. He remained a personality until he was given the power to run car companies, decide the value of our medical needs, and to generally spread the wealth down.

The GOP needs to move right with strong principles, strong voices, integrity, and clear objectives. Less government. Less spending beyond our means. More freedoms. More of our earned $ in our pockets.

WSJ Helps Clarify



Per the Wall Street Journal, here's the information your credit card statement will include. The idea is to force the consumers to see exactly how much interest the bank will get from them if they continue to make minimum payments. Also, how many months (divide that number by 12 to get the years) until the balance will be paid off!

Credit card companies will allow us 21 days from statement issue date to due date. It has been 14 days.

We can expect to see the return of the annual fee. Maybe some are too young to remember annual fees. Bob and I have paid as much as $75 a year for the privilege of using a Visa years ago. We currently pay $40 a year for our small business American Express card. The difference is it's deductible against our company's income.

Texas

Texas has no income tax. None.

More jobs were created in Texas last year than all over 49 states combined!

Who creates these jobs? People who get to keep more of what they make. That would be richer people. Who in the world wants to work for a poor man or a poor company?

I have had my paycheck bounce twice in my long life. The owner of the store I worked for was himself living paycheck to paycheck from his job and during the lean months at the retail store, he could not cover the payroll on a timely basis.

I prefer working for someone who has enough $ to pay me.

Way to go, Texas!

Sunday Commencement

Today is the Commencement at Notre Dame. The guest speaker at this Catholic institution is from Illinois where he tried as a member of the state congress to pass the most liberal abortion bill ever conceived.

In Illinois the bill was known as "Leave 'em in the sink" because B. H. Obama wanted any viable fetus aborted not be provided any ANY medical care once it left the womb. The mother wanted to rid herself of this burden but the medical community would not agree to remain "hands off" should the product of conception show any signs of life. The discarded cell group was not to be considered life even then.

This man will likely not address the graduates and honored public with any mention of his stance on abortion. He will likely discuss the rights all Americans (and any immigrants standing on our soil, legal or otherwise) to health care. Health care.

Can this man really rail for the rights of the living when he demanded the medical community ignore the baby in the sink?

Disgraceful Wealthy

"Did you study business? Why not help our struggling non-profits find better, more effective ways to serve folks in need." So stated our president at the commencement at Arizona State this week.

He implied it was far worthier to work helping others and to avoid aiming at the old emblems of achievement. Possibly one of those disgraceful symbols would have been to send your child to college. A slam on the parents who forked over $50,000 or more to have their offspring commence.

But, let's look at it another way. Possibly Mr. President meant for these young people to earn and earn and earn so as they could help non-profits with $. I want to believe the approach should be to support charities, medical research, churches, soup kitchens, animal shelters, disaster relief organizations, blood banks, the arts, etc. Not to dwell on the things of life but the power financial freedom gives and how through that freedom others can be helped.

However, knowing his statist (Marxist/Fascist) goals, Obama would never tell young people to earn and earn. That is the trouble. No one will be earning and earning and giving and giving. We will just take, envy, take, envy, take, take, take. Give me, give me, give me.

Increased Taxes

Bob and I do not make $235,000 or more a year. That's right - the original limit was $250,000 per year but it has been lowered.

Possibly you will also not be hit with increased income taxes; however, you and I will get hit with other tax hikes.

Higher taxes on cigarettes. Higher taxes on sugared drinks. Higher costs due to Cap and Trade. Cap and Trade will cost the average American household over $3,000 per year.

Possibly our medicare withheld tax will be increased to help cover government health care. It is currently 1.45% of each earned $1. It is matched by your employer. I suspect this rate will increased to 2% by the end of 2010.

The number of unemployed rises each month. Costs are covered in part by your employer who pays the state unemployment tax based on experience and industry. Bob's little company pays 0.6% unemployment to the state of Illinois but it has been as high as 2.1%. Even the uneducated can guess that these rates will double for employers. This will hit small companies very hard too.

No taxes or lower taxes if you make less than $235,000. Grab your wallets. It's not over by far.

Dr. Uncle Sam

How will the government do managing my health care? And yours? They talk like it'll be wonderful like in Europe and Canada. Wish we could check out a crystal ball and see what things will be like.

Wait.

The government handles the health of our veterans so well.

Do you know a vet who relies on government doctors and clinics? Do you know anyone who has spent time in a VA hospital? Wonderful experiences?

My dad lost his free health coverage in retirement and came to rely upon the VA doctors. I do not remember how long he was made to wait to be seen even after getting an appointment. I need to check with one of my sisters who sat in the waiting room (or holding pen) with a very impatient 80+ year old vet.

Dr. Sam will decide if I get my mammogram. He will decide if your ankle pain requires an xray. He will decide if your third visit for the same complaint is warranted.

Won't this be fun.

What Does It Cost?



To get this photo and a few others, it cost We The People about $357,000. It is believed a Photo Shop production would have cost pennies on the dollar.

What did the panic cost? Thousands fled office buildings. Tourists were frightened. What did it cost the employers and the tourism of NYC?

On Tuesday, the breaking news was the hamburgers shared by the VP and President in Virginia. I read $7 for the burger plus $5 tip in the jar. What did the ride cost We The People? The limo and motorcade are always at the ready but the disruption on the roads at noon? What did it really cost for the photo ops?

While the country's unemployment levels reach that of 1983 and many are tightening their belts, why does Washington not ask the true cost? Why cause more damage?

One More Thing

To raise capital there is one more thing the banks can, and some will, do. That is sell assets.

Yesterday the family across the street had a garage sale. They have 2 girls. One is in preschool and the other is in 2nd grade. They had toys, books, and clothes neatly displayed on tables in the garage spilling out onto the driveway.

Rachel said it was a good day. She has a couple bags for Goodwill and will see if the school wants any of the books. She didn't disclose how much $ she took in but she seemed quite pleased.

Will your bank have a sale to unload extra desks and coin counters? There may be some bargains. Maybe you should inquire the next time you're there taking out $.

Report Cards

The market will close today and then the report cards will be revealed. Will your bank be one of the strong ones? Maybe just average?

What if your bank gets a failing mark from the All Knowing, All Caring Government? What if Tim The Tax Cheat doesn't like my bank's balance sheet? What then?

The "bad" banks will be given time to raise more capital. How does a business raise more capital? They can make more sales by offering higher interest rates in hopes of luring more deposits. They can sell more stock.

More stock sales may dilute the existing certificates. Plus, who do you think would invest in one of these "bad" banks. I can imagine depositors will move cash reserves to a "good" bank.

My fear is the government in its great wisdom will be issuing death certificates for many banks after the market closes today.

Pesty Amendment

Our Fifth Amendment to our Constitution:

"No person shall be held to answer for a capital, or otherwise infamous crime, unless on presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation."

The kicker that President Obama (not really our king) will have to clear is: nor shall private property be taken for public use, without just compensation. Just compensation. That's just under the law not under some bleeding heart justification.

Moved Too Far

The Grand Ole Party (Republicans) has moved too far right. Too far conservative.

Excuse me. I think the opposite.

Can you give examples of Republicans who have moved right and not more central or even left.

Can you site clear distinctions between candidate McCain and President Obama? Please give me examples of John being so far right or even more right than George W.

I believe the country needs clearer and stronger conservative voices. That's what I pray for.

Finger Pointing

"I do not stand with them." That's stronger than pointing a finger. These were the words of our president regarding secured lenders (holding a claim on assets for the risk they take) who refused to take 29 cents on the dollar. Darn, they even turned down nearly 33 cents on the dollar. How dare they.

The villains are identified as hedge funds. Those nasty creatures who caused nearly all of our economic woes. Those greedy old men sitting in their high towers.

Most of the holders of the secured debt (they have a chance in bankruptcy of receiving something from the courts for their investments) are not specifically identified. We have been told some of the $ is held in pensions and retirement funds.

Those greedy people. Obama does not stand with them. He stands with the UAW (many many votes) and the receivers of TARP who are totally without power.

Let's see if the courts will break from the Dictator's wishes and uphold the law.
